Terms of Service

Welcome to CacaoFlow. These Terms of Service ("Terms") constitute a legally binding agreement between you and CacaoFlow ("we," "us," or "our") regarding your use of the CacaoFlow mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users of the App.

2. Eligibility

You must be at least 18 years old to use CacaoFlow. By using the App, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You will use the App in compliance with these Terms and all applicable laws
• All information you provide is accurate and truthful

3. Description of Service

CacaoFlow provides the following services through the App:

• Guided ceremonial cacao practice templates
• Dosage recommendations based on user-provided information
• Intention-setting tools and tracking
• Audio guidance for meditation and breathwork
• Journal and reflection features
• Practice statistics and tracking
• Educational content about ceremonial cacao

4. User Accounts and Subscriptions

4.1 Free Trial

CacaoFlow offers a 7-day free trial for new users. After the trial period:

• Your subscription will automatically renew at $4.99 per month unless you cancel
• You can cancel anytime during the trial period without being charged
• Cancellation must be done at least 24 hours before the trial ends to avoid charges
• Free trial is available once per Apple ID

4.2 Subscription Terms

Premium subscription includes:

• Unlimited ceremonies per month (free tier limited to 4)
• Full practice library access (10 premium practices)
• Custom ceremony builder
• Offline audio library access
• Advanced analytics (future feature)
• Journal export (future feature)

4.3 Payment and Billing

• Subscriptions are processed through Apple's App Store
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings
• No refunds for partial subscription periods

4.4 Cancellation

To cancel your subscription:

1. Open iOS Settings
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select CacaoFlow
5. Tap "Cancel Subscription"

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until then.

5. User Responsibilities

As a user of CacaoFlow, you agree to:

5.1 Safe and Responsible Use

• Use ceremonial cacao responsibly and in accordance with traditional practices
• Follow all safety guidelines provided in the App
• Provide accurate information (weight, experience level) for dosage calculations
• Not exceed recommended dosages without professional guidance
• Discontinue use and seek medical attention if you experience adverse effects

5.2 Prohibited Uses

You agree NOT to:

• Use the App for any illegal purpose or in violation of any laws
• Share your account credentials with others
• Attempt to circumvent subscription or payment systems
• Reverse engineer, decompile, or disassemble the App
• Copy, distribute, or modify any part of the App without permission
• Use automated systems or bots to access the App
• Interfere with or disrupt the App's functionality
• Upload malicious code or attempt to compromise security
• Use the App if you are under 18 years old
• Provide false or misleading information

6. Intellectual Property Rights

6.1 Our Rights

All content in the App, including but not limited to:

• Text, graphics, images, and user interface
• Audio files, music, and guided meditations
• Software code and algorithms
• Ceremony templates and practice guides
• Trademarks, logos, and branding

...are owned by CacaoFlow or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

6.2 Your Rights

You retain ownership of:

• Your personal journal entries and reflections
• Your ceremony notes and intentions
• Any personal data you input into the App

You grant us a limited license to store and process this data solely for the purpose of providing the App's services to you.

7. Content and User-Generated Data

7.1 Your Journal Entries

Journal entries and personal reflections are:

• Stored locally on your device
• Not shared with us or any third parties
• Your sole responsibility to backup (future cloud backup will be opt-in)
• Permanently deleted if you delete the App or reset data

7.2 Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the App:

• You grant us a perpetual, worldwide, royalty-free license to use such feedback
• We are not obligated to implement any suggestions
• We are not required to keep feedback confidential

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of dosage recommendations
• Warranties that the App will meet your specific requirements

CEREMONIAL CACAO DISCLAIMER: The App provides educational information about ceremonial cacao practices. We make no warranties about:

• The safety or suitability of cacao consumption for any individual
• The effectiveness of any practices or ceremonies
• Any health benefits or outcomes from using ceremonial cacao
• The accuracy of dosage calculations (which are estimates based on traditional practices)

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

CACAOFLOW, ITS DEVELOPERS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Personal injury or property damage
• Adverse reactions to ceremonial cacao
• Medical expenses or healthcare costs
• Any damages resulting from your use or inability to use the App

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM (MAXIMUM $59.88).

10. Indemnification

You agree to indemnify, defend, and hold harmless CacaoFlow and its developers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any adverse effects from consuming ceremonial cacao
• Your failure to follow safety guidelines

11. Third-Party Services

The App integrates with the following third-party services:

• Apple App Store: For payments and subscriptions (subject to Apple's Terms)
• RevenueCat: For subscription management (subject to RevenueCat's Terms)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

12. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

13. Updates and Modifications

13.1 App Updates

We may release updates to improve the App, add features, or fix bugs. You agree that:

• Updates may be automatically downloaded and installed
• Some features may require the latest version
• We may discontinue support for older versions
• Updates do not constitute a new agreement

13.2 Terms Modifications

We reserve the right to modify these Terms at any time. Changes will be effective:

• When posted in the App with an updated "Last Updated" date
• After providing notice through the App or email
• 30 days after notification for material changes

Your continued use of the App after changes constitutes acceptance. If you don't agree, you must stop using the App and cancel your subscription.

14. Termination

14.1 Termination by You

You may terminate your use of the App at any time by:

• Deleting the App from your device
• Canceling your subscription through Apple
• Contacting us to request account deletion

14.2 Termination by Us

We reserve the right to suspend or terminate your access if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• We discontinue the App
• Required by law or regulatory authority

Termination does not entitle you to a refund of subscription fees.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

15.2 Dispute Resolution

Before filing a lawsuit, you agree to:

1. Contact us at radek@jozefowicz.dev to resolve the dispute informally
2. Allow 30 days for good faith negotiation
3. Provide detailed description of the dispute and desired resolution

15.3 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules, rather than in court, except:

• Small claims court actions (under $10,000)
• Intellectual property disputes
• Where arbitration is prohibited by law

15.4 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CacaoFlow regarding the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We are not liable for any failure or delay due to circumstances beyond our reasonable control (natural disasters, war, pandemics, etc.).

16.6 Export Compliance

The App may be subject to export laws and regulations. You agree to comply with all applicable laws.

17. Apple-Specific Terms

If you download the App from the Apple App Store, you acknowledge that:

• These Terms are between you and CacaoFlow, not Apple
• Apple has no obligation to provide support or maintenance
• Apple is not responsible for the App or its content
• Apple is a third-party beneficiary of these Terms
• You must comply with Apple's App Store Terms of Service

19. Acknowledgment

BY USING CACAOFLOW, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
